New article in the DULJ 🤓 It covers guardianship for unmarried fathers, reciprocal IVF & citizenship and how all of these important legal issues have been scuppered not by an intention to exclude (🤞🏻) but by drafting issues. I find it so interesting but like, I wrote it #biased

A really constructive meeting today with LGBT+ Parenting Alliance, along with Ministers @DonnellyStephen and @rodericogorman, discussing the ongoing work to improve our system of Assisted Human Reproduction.

Notice anything about this map? Once again, the Northwest is left out. While over 1,000 couples across Ireland celebrate access to publicly funded fertility treatment, our region is left in the cold. A glaring injustice. When will the Northwest get the care we deserve?

Having considered the Health (Assisted Human Reproduction) Bill 2022, the President has signed the Bill and it has accordingly become law.

She must consent to the parental order which transfers parentage to the intending parents. The Court cannot under the Bill, dispense with her consent unless she is deceased, cannot be found or lacks capacity to consent. This AHR Bill is likely to become law next Wednesday.

This is in the context of the AHR bill 2022 where even though the surrogate has the benefit of legal advice, counselling, physiological assessment all pre-transfer of embryo and has no genetic link to the child, she is the legal mother at birth and is registered on the birth cert

Part 2 is out! 🥳 Part 1: there’s no legal precedent that requires legal parentage to be assigned to a gestational surrogate. Part 2: even if you don’t agree, there is precedent for a framework dispensing with her consent to the parental order (in favour of intending parents)👩🏻‍⚖️
