The lawsuit asserts that the 1st Amendment protects students’ right to information & authors’ right to free expression. The plaintiffs are asking the court to block Rutherford Co. from continuing to ban books in schools & to reinstate many of the already banned/restricted books.

CONTEXT: Rutherford Co. started banning books by informal requests from board members, initially without any public meeting or board vote. By fall 2024, the board began banning books based on a website created by individuals associated with the far-right group Moms for Liberty.
