This should be illegal and needs to be tested by the courts. The consumer was sold a perpetual license and the seller revoked it after the point of sale. In any other industry this would violate consumer law, but the courts are unaware or don't want to examine this issue.
So I am now officially never buying a Vegas editing software again.
The Developers have removed Vegas Pro Edit 15 for purchase on Steam and are now revoking licenses for the software. I'm now out $150 and no longer have an editing software. Very cool!
Please retweet for awareness
Campaign video to stop games from being destroyed! It's being done in a few ways, owners of the game "The Crew" can help especially. Go to for instructions on what to do. A much shorter version (50 seconds) will be up tomorrow.
has been making far more news than I anticipated, but this might be the first article that's because of something new Ubisoft is doing, not us. I encourage anyone interested in the law in Europe especially to analyze this behavior.
Google is working its hardest to ensure more games will be destroyed. Remember, streaming + exclusives = NO ONE will be able run the game in the future once support ends. It's like building multi-million dollar sand castles that will crumble.
"Games as a service" is fraud!
This is maybe the most boring video I've done so far, but I think it's important as far as gaming, very fact-heavy. If it's too long for you, I encourage people to watch the ending at (1:10:00)
The UK petition is up! Finally! We had to soften our language a bit from the original version, but we were able to keep all the important parts (the main part had to be 300 characters or less also). Go sign it if you're a UK citizen or resident!
It looks like my worst nightmare for gaming is starting. Google is working on streaming-only games, which of course, makes game preservation impossible. I'm working on something very big related to this that should come out shortly after I'm well again. This isn't over.
While I appreciate the coverage, the framing from PC Gamer is basically propaganda at this point:
"It's the nature of online games: Nothing lasts forever."
Except almost every online multiplayer PC game from the 90s - early 00s. They still work.
I'm getting reports that people are having The Crew revoked on people's accounts on Ubisoft Connect. I'm not sure that even matters since they made it inoperable anyway, but many in Europe seem to think this is illegal. Maybe, doesn't change our plans either way, can only help.
I've heard a narrative lately of how you're "leasing" games you buy online. I don't know where this is coming from. Unless you're paying a subscription fee, this is false. You're BUYING a PERPETUAL license. Many companies don't honor this, hence why it needs legal attention.
The UK petition got a reply and is about the worst non-answer expected and shows either a lack of understanding or a refusal to address the problem. It ignores
-no stated duration when a game will end
-EULAs circumventing compensation
EU is looking better.
The Crew is shutting down next year and since it's online-only, it will be dead for good. Looks like I was off by 2 years. It's still one of the largest open world driving games made. What a great business model throwing all that effort into the trash.
This might be the first time I've ever seen a game journalism outlet point out that always online = death of the game (the way almost all companies handle it) at the LAUNCH of a game. Good.
I feel like this story is pretty significant. The creator of Terraria got locked out from Gmail, Youtube, Google Play Store all at once with no reason given. This is why monopolies are not great. YT especially is a de facto monopoly by a large margin.
It looks like I've made game news, though I think it's premature since we're still in the brainstorming phase.
To clarify, there may or may not be a lawsuit, but I will pursue every legal avenue I can that's affordable, domestic + international.
Apparently in the late 1800s there was fear that installing electric street lamps at night would disrupt sleep patterns and thus cause a wave of madness across cities. That sounds like a pretty solid premise for a videogame to me.
@jeffgerstmann
This is exactly the sort of thing I'm trying to prevent, the legality of this is untested in a lot of countries (not the USA). That said, it might be impossible for lawmakers to understand "multiplayer shutdown", so we're focusing on a full game death at
Just as a reference for any future incidents, you can assume any NFTs on my name, videos, etc. is not me and is 100% fraud. I hereby authorize the entire internet to take actions against that on my behalf. I have way more things I'd rather do with my time than mess with that.
I'm hearing how a subreddit propped up Gamestop stocks + others to make hedge fund firms backfire to the tune of billions. Now their reddit has gone private, their discord shut down, and broker sites are freezing trades. To quote Half-Life 2: "You stirred up the hive."
The Unity engine is going all-in on user hostile decisions lately. Some I've heard:
-They'll be charging devs PER INSTALL of games they're selling (not per sale)
-They're essentially adding spyware to have the above
-Free edition is going to be online-only to use the editor.
To all Australian owners of "The Crew":
Send me an email or twitter message so I have a way to contact you later. I don't need your personal info, but later we'll have a law firm you can send it to which will help on getting the ACCC's attention on game destruction.
After almost a month, the BBC is doubling down on the copyright claim against my video even though it was Fair Use (Fair Dealing in UK law), so I'll be doubling down my dispute. If they triple down, there will be one more step before it escalates to legal action. Fun times.
The current Game Dungeon is taking too long, so I'm going to push it to November and just move forward on Halloween stuff + FM. So instead of more Game Dungeon, you're going to get more Game Dungeon.
Youtube has informed me that my channel is going to be unverified starting October. I plan to appeal the decision, we'll see if Youtube thinks I'm real or not. It raises the age old question: can you ever really be sure you're you?
I'm going to have to start using Duckduckgo. Google search is resembling what it replaced back in the 00s. I had a game I was trying to remember the name of, used a description, Google + Bing latched on to buzzwords, couldn't find it. DDG had it the first 2 hits.
The Internet Archive / Wayback Machine could go down due to a lawsuit. Grab anything you think you might want (hard to predict). I think the IA probably committed piracy AND it's impossible to legally preserve many works. Nobody wins.
A lot of people have been asking my opinion on the Helldivers 2 fiasco. It sounds like a mess and another grey area that's hell to deal with legally. Unfortunately, what we're doing wouldn't prevent that, but rather it would save the game when it got shut down for everyone.
I feel like a jackass saying otherwise earlier, but the next Game Dungeon won't be this month. It ended up being 20 minutes longer than I thought it would, but it's a more interesting episode because of it. I'm working to get it out ASAP, current estimate is this weekend.
Yes, great, this is exactly what I want; Youtube threatening to ban likely a significant portion of my audience. If this goes through I'll try to speed up the process of getting my videos on another platform also:
I've just learned that it's safe to wait only 1 week with no response from Ubisoft about The Crew before contacting the DGCCRF instead of 2. The guides will get updated on it later.
The "game as a service" video's cleared half a million views. I think on my channel, only FM2:Ep1 went up that fast. Regardless of what people think of it, it looks like I hit a nerve.
The director of Stadia got my blood pressure up. Had a reddit AMA, was asked about EoL plan for games. He dodged the question, said the cloud is wonderful.
Translation: All your games will be unplayable when we shut it down, but we love it right now.
I was going to mention this as a conspiracy theory of mine in a future video, but it's already happened. Future versions of Windows will require an internet connection + Microsoft account. This is basically the end of PC ownership using Windows.
What Machinima did + games designed to die I find dystopian. Historically, art is intentionally destroyed by vandals or those who hate its message. Now, more is by caretakers against the will of its creators and supporters for convenience. What kills me is the normalization.
Cool, my income is getting cut. Youtube is implementing a tax on creators outside the US. I read this as YT hasn't been following the law for about 14 years. I pay taxes on my income in Poland, so I think this will be double taxation for me. I'll figure this crap out later.
Great, Capcom is coming out as explicitly against modding. It sounds like they want to tie mod prevention into DRM measures, which could shut down mod distribution significantly, because then it would be banned from many sites as promoting piracy.
The latest Game Dungeon just got copyright claimed by the BBC and has been demonetized. I'm disputing it under Fair Use law, they have to give an initial response after 30 days. I've fought them successfully before, but I never trust the system even if the law is on my side.
The UK petition response has one positive part that details clearly illegal activity by the videogame industry, but requires highly specific conditions on how people can report it. I'll have a video detailing everything on it later on; will probably need a UK lawyer to weigh in.
I don't like the language being used here. If access to an old title has online-only DRM and is only accessible through one company that can shut it down at any time, they're not "preserving" anything. Don't let them change definitions of words.
Rendering Game Dungeon now, this one will take longer than usual to process and doublecheck. Assuming there aren't consecutive problems and it passes Youtube's bot checks, it should be out later today.
The copyright claim on Game Dungeon by the BBC was lifted. After escalating it, they let the appeal run down the clock for 30 days, wasting both sides' time and energy for almost 2 months. Maybe I'll do a Doctor Who RGD after the BBC is dead.
Response to the video is good so far; I'm getting a lot of multi-page emails about possible legal proceedings + dozens of people claiming they have receipts. It will take me some time to get through them, but you can keep them coming.
Some people are having issues contacting Ubisoft support on The Crew. There could be some server overload, so it's fine if you wait a few days to try again. If they're intentionally blocking it, that + the shutdown message could be sufficient evidence, but we need proof first.
To French owners of The Crew: If you've already sent a registered letter to Ubisoft, please contact me (on twitter or email). We could use a few more people to help with the next step for a legal mediator.
We've added a mailing list to for those interested, but no obligation to sign up. It's primarily going to be to inform people of when government petitions in various regions open up since we've had so many delays with those.
Good and bad news. The Australian proposal is up, but it got hijacked and now includes ALL software, so I think it's likely doomed. Australians may as well sign it, but this really screws things up. At least we'll still be contacting the ACCC.
I've heard The Crew 2 and Motorfest are being review-bombed. To clarify, that's not a goal of the campaign, but I don't care either; people can rate games whatever they want. My first thought of The Crew 2 is the awful always-on blur filter and I've never played Motorfest.
Good news, Germany is opening an antitrust probe on Facebook for requiring their VR headsets to have a FB account. I would go even further and go after them for banning offline driver installations, ensuring it's bricked if you don't connect to them.
Ross's Game Dungeon: Phantasmagoria 2!
This is age restricted since it has everything. Feel free to spread the word on it since I'm sure it won't get linked by YT because of that. The longest RGD made and I think one of the best ones! Happy Halloween!
I finally met my other neighbor at my apartment. She's cool with me being loud for voice recording, so that means Freeman's Mind is a go as soon as I'm done with the next Game Dungeon. She also can't stand the drilling and looked like she wanted to murder whoever's doing it.
This is kind of lame. I think dislike ratios can be helpful and reflect a populist sentiment. Medium ones usually mean something is controversial. High ones usually mean something is either wrong, really bad, or represents some related scandal going on.
New Game Dungeon in a couple days. My original "Ross time" for it was today, but I thought "maybe I shouldn't announce that" and that ended up being a good idea. Before I did videochats and twitter, people would think I died in between releases, it wasn't the worst system.
A viewer emailed me informing me my Youtube channel is apparently an NFT. I don't have a lot of time or interest to fight this, but feel free to on my behalf, using this twitter post as evidence. We've entered very weird levels of fraud here.
Quick update:
-I've been trying to get Game Dungeon out this month, but I think it's going to be a couple days late, aiming for this weekend.
-next FM still done except for sfx, guy who's been helping me has been busy, so it's unfortunately in limbo
-other videos coming
I feel like I'll be done with the next Game Dungeon sometime tomorrow, but with my time estimation skills, that probably means Sunday or Monday. It's going to be an over an hour long, there was a lot to say, I'm pretty happy with it though.
The AF website will be down for a bit for maintenance, it will come back. Also I've been working almost nonstop on the campaign to stop games being destroyed, will have more details later on. We'll be pursuing a LOT of options, more than I originally thought.
The curse has been lifted, new Game Dungeon! In retrospect, this one went on for too long, I recommend watching it chunks. I hope to have things be a little more refined in the future. Next ones won't take as long to come out!
Updates:
-FINALLY have a new apartment lined up, get to sign contract Monday, will move soon after.
-Will probably have Dead Game News out before then
-Have a bunch of videos coming October. Minimum 3, hope to have 5 or 6.
A reply to a user contacting the Verbraucherzentrale:
(on digital products)
"...the consumer advice center demands that retailers must indicate how long a product can be used before purchasing it, so that consumers can decide for themselves..."
(continued)
Steam is finally going to allow game soundtracks to be sold separately. I think Valve is 10+ years late on something that should have been obvious, but I'm still glad they're doing it:
Wow, more on the ads, apparently they're toying with having 10 consecutively. If I had to guess, this is probably in between videos, so 5 before, 5 after. I disable "after" ads on my videos in addition to midway ones, but 5 is still way too many.
@thisgyde
Just to clear up any confusion, I mean they were sold a perpetual license to a copy of Vegas Pro 15, not of all versions of Vegas Pro in perpetuity.
I was informed of this a bit late, it turns out Razer isn't the only company to have online DRM with their mouse, Roccat does also. There is no way to install the drivers offline, it requires a connection to their server. Once again, I think this crap should be illegal.
Just saw some good gaming propaganda:
"Godfall is not a service game, but does require an internet connection to play."
This is a bold denial. This is like saying auto-repair isn't a service, but it does require someone to actively fix your car.
Going to try and upgrade my CPU / motherboard today to a fan-donated one. I'll be moving from a 2014 one to a faster one from 2014. Soon, I'll have some of the best 2014 has to offer.
Louis Rossmann (maybe the biggest name on Right to Repair issues) mentioned The Crew shutdown and gave my coverage a mention. It's cathartic seeing I'm not the only one frustrated by this. Maybe we'll both talk about this more in future.
