It’s important to note that the judge who set the release conditions for N & K felt that there was not probable cause for one of the felony charges. Unfortunately, because of the way the state has chosen to proceed, the judge’s opinion won’t matter at this point in the process.

At these hearings, a judge has the ability to decide whether or not there is probable cause for indictment. But, these hearings were vacated and this process was abandoned in favor of another process in which an assembled grand jury decides whether or not to indict, instead.

N & K’s charges have moved from informal to formal. This means that the charges that were initially just allegations from Phoenix PD have now been filed by the prosecutor. K & N were scheduled to appear for both a status and preliminary hearing on 07/13 and 07/15, respectively.
