IM28 would make South Dakota the only state in the nation that doesn't tax tobacco at all. It would force massive funding cuts to schools, nursing homes, and law enforcement. It's a terrible draft of a costly idea. SD should reject the Tobacco Tax Repeal this November.

The Attorney General, in the state's official explanation, acknowledges that the measure goes far beyond food and drinks and specifically points out the impact on tobacco revenues.

So, IM 28 would repeal all taxes on everything from tobacco to toothpaste to candy to paper products and everything in between. The proponents have been misleading the media and public by calling it a "food tax repeal," when it actually goes far beyond that.

Black's Law Dictionary, the gold standard for legal definitions, defines "consumption" to be "the act of destroying a thing by using it; the use of a thing in a way that exhausts it."

The measure is short, and reads as follows: "the state may not tax the sale of anything sold for human consumption, except alcoholic beverages and prepared food."
