A judge in Alabama issued a decree to release all people in jails with bonds of $5K or less and got a lot of pushback. Here is a part of his explanation, which is profound and telling.
It's been days and I still can't get over how a judge set a *$1 million* bond on a woman in Georgia who had cotton candy that was alleged to have been meth and sat in jail for three months before a test finally revealed that the cotton candy was not meth.

Law school is a quarter-million dollar investment made so that you can upgrade your manner of arguing from “I think that...” to “My understanding is that...”
When I was a child, I was a victim of severe child abuse. This set my progress through life back my many years. With the support of altruistic friends, I was able to make it to law school and I've recently accepted an offer to be a public defender after graduating. I am grateful.
People underestimate how devastating a stint in jail can be even when charges are dropped. This mother spent a week in jail and lost her job and children. The charges were then dropped b/c of mistaken identity.
Law School: Argue the law and use reasoning within a legal framework to secure your client's outcome. All that matters is the law.
Reality: I wonder what mood judges will be in the day after Christmas.
Law schools would do well to recognize that there are some students who come from families which include no lawyers, which come from social circles that do not include lawyers, which come from classes that could benefit from legal representation if they could afford it.
It’s not the kids who argue a lot who need to be encouraged to go to law school
It’s the kids who’ll learn a board game and then argue over the meaning of the rules who should be encouraged to go to law school
The way Kamala Harris says "I'm a prosecutor" here makes it seem as if the deprivation of the rights of people who have been convicted of crimes is a core aspect of being a prosecutor.
It is not. The prosecutor should seek justice.

The issue with Lori Loughlin's sentence is not its relatively short length. The issue is whether that leniency can be extended to people who are not as privileged and are brought through the punishment system.
People often ask why I would want to legally represent society’s downtrodden and most-forgotten...
...and frankly, it’s because of my own personal experience of being a member of the downtrodden and most-forgotten that I want to do this.
Everyone deserves representation.
Unpopular Opinion: Any legislation passed in response to this week's events will have dire consequences for marginalized groups. We don't need a repeat of The PATRIOT Act. And there are other ways to address the threat from these zealous Trump supporters.

I am so sorry. My son was born with a cleft palate and he is due for surgery in a few months. His experience opened up my eyes to facial differences in children. Despite these differences, our children are just as worthy of love as anyone else.
If you are an attorney and are dating someone who is not an attorney and you are watching a dramatic TV/movie trial scene with them and are not constantly interrupting them to point out all of the mistakes in the scene, you might not be worthy of the profession.
Been watching The Lincoln Lawyer on Netflix and realized that one of the most unrealistic aspects of TV portrayals of trials is that witnesses almost always show up to court on TV.
There are some first generation law students who do not have a single lawyer in their respective families and who are genuinely proud to be the first attorney.
They do not need to hear the discouragement of how grueling it is to be an attorney.
Let them break the mold.
I was going to begin my bar exam application tonight and then noticed that the fee is $650.00 so now I am just going to stare in my bathroom mirror and call for Bloody Mary and then try again tomorrow night.
If a court system can suspend misdemeanor trials for longer than a year, that might be a sign that a significant number of those cases can be disposed of.
Med Schools: Let's get our senior students to graduation ASAP and send them out to combat this crisis.

There is such a strong nexus between what Batman does and what Gotham’s police department does that Batman should be considered a state actor and should therefore be held liable for any civil rights violations carried out in the course of defending Gotham from villains.
People hate on public defenders but I don't know a single public defender who went into their career because they couldn't find some "high profile" legal career. They went into the work because they're passionate about it & want to hold The State to its burden in criminal cases.
This story just fills me with an excessive amount of rage. And let me tell you...the punitive mindset that allowed a 15-year-old to be sentenced to life without parole continues to exist to this day.

Seeing both a Black man killed by law enforcement in my city and the cementing of a high court that will defer to law enforcement all in one night was too much.

As a public defender, seeing police reports that begin with minor traffic infractions is extremely routine. These are infractions for traffic code violations that are selectively enforced.
Some have taken issue with my decision to disclose my class rank in law school. Real issues came up during law school that prevented me from a higher rank. But I’m here to tell law students that you can rise above your rank. For the most part, grades will not define your career.
After the LSAT fee, law school application fees, tuition money, money for books, the MPRE fee, the bar exam fee (don't forget the additional fee to use the laptop to take the exam!), I'm hoping this *filing fee* to the bar is the last damn thing I have to pay to be an attorney.
What kind of a prosecutor goes forward on charges that call for a *mandatory* sentence of 110 years in a case in which a truck driver who lost control of his truck unintentionally caused the death of four people?
If law schools are invested in their graduates’ bar exam pass rates, then the last semester of law school should be a semester-long bar exam prep course paid for by tuition and should end with the bar exam itself.

The thing about public defenders is that you can reach out to any public defender in the country if your client has an open case in their jurisdiction and they will undoubtedly help you.
Anyone else do the depressing routine of waking up, scrolling through your phone in dread for an hour in bed, then get up to start whatever the day can be?
If jails and prisons won’t allow in-person visits because of the coronavirus, then there should be no charge for phone calls...
...there should have been no charge for phone calls to begin with, but this should be a start.
For all lawyers working in public interest fields, I have this to say:
There is a tremendous amount you can learn from social workers working with the same clientele you are working with.
Today is the 57th anniversary of Gideon v Wainwright, the Supreme Court decision providing the right to an attorney if a person cannot afford one in a criminal case. And throughout the country, public defenders are still working to advocate for clients during a pandemic.
Attorneys who do direct services (legal aid, public defense, immigration, etc.) can provide as much to the legal discourse as those who do impact litigation.
Just my unpopular opinion...
Interesting case. A homeless person who builds his home with cardboard boxes each night allegedly stabbed a student who kicked the structure and is using the castle doctrine as a defense. Under the doctrine, a person can protect a home with deadly force.
When I was a 2L in law school, I thought that when I would be a 3L on the verge of graduating, I’d definitely be able to tweet out some self-care tips for law students.

One thing I didn’t realize about Batson v. Kentucky, the case that challenged discriminatory peremptory strikes, is that it was James Batson, the appellant, himself who instructed his defense attorney to object to the prosecutor striking the only three Black jurors from the pool.
If you are an attorney, never wait until the day of a court hearing to print or to copy or to scan something…the court gods will ensure that the technology will fail on the day of.
Legal Writing is hard.
From high school up until the year I started law school, I was always told by fellow students and teachers and professors that I was a great writer.
But this Legal Writing thing is hard AF.
Watching this new Netflix documentary series on 9/11 and I have to say this: Barbara Lee’s singular, lone vote against the Authorization for Use of Military Force remains one of the most courageous, principled acts of honor and strength in the political history of this country.
