Pocket rescissions continue to exist as a lawful tool available to the Executive Branch to reduce unnecessary spending. President Trump is always taking bold, decisive actions to put AMERICA FIRST – and last week’s pocket rescission is a perfect example. 🇺🇸.

President Ford also used a pocket rescission in 1975. At the time, GAO provided recommendations to Congress on how to amend the ICA if they wanted to stop any future pocket rescissions. Congress did not make those amendments, allowing pocket rescissions to continue!

Pocket rescissions are grounded in history and law. One was last used 48 years ago when President Carter sent a rescissions message to Congress shortly before the end of the fiscal year, which resulted in the lapse of funds for foreign military sales credits.

Under the ICA, the Administration may continue withholding the funds for a 45-day window. When the fiscal year ends on September 30, the spending will lapse.

A pocket rescission is a standard rescission, but one sent by the President to Congress with fewer than 45 days left in the fiscal year. In this case, Congress can choose not to vote, to rescind, or continue the funds—it doesn’t change the outcome.

The President may propose to rescind funds appropriated by Congress. Earlier this year, Congress passed President Trump's rescission of $9 billion in funding that went to NPR, PBS, and other woke foreign aid.
