He should urge Sri Lanka to ratify the Rome Statute retrospectively from 2002, when the peace process began, and to incorporate the crime of genocide into its penal code. Peace without justice is neither durable nor meaningful. #InternationalJustice #TamilGenocide

Mr. Solheim, having played a central role in the peace process, now has a moral responsibility to advocate accountability for the genocide, crimes against humanity, and war crimes committed against Tamils after its collapse, particularly the killings at the end of the war.

Although the sub-committees were meant to address issues in the Tamil North-East, the LTTE nevertheless agreed to equal representation for the Government of Sri Lanka, a further demonstration of its willingness to be flexible for peace.

When it became clear that accepting an interim administration would cost Ranil Wickremesinghe his office, Mr. Pirabhakaranmagnanimously exercised flexibility, agreeing instead to powerless sub-committees to preserve the peace process. This flexibility is rarely acknowledged.

One of the primary reasons the LTTE entered negotiations was to establish an Interim Administration to address the urgent humanitarian crisis in the NorthEast. Prime Minister Ranil Wickremesinghe had an electoral mandate for this.

I still recall arriving in Thailand to see a banner reading “Sri Lanka Peace Talks.” It was deeply unsettling. It should have read “Sri Lanka–LTTE Peace Talks.” Even today, this mischaracterization persists and reflects a continuing misunderstanding by international actors.

A core failure of international facilitation was the refusal to acknowledge the true nature of the conflict: it was between two political entities, the Sri Lankan State and the Tamils, represented by the LTTE, not two factions under a single sovereignty.

Insisting that negotiations remain confined to that very constitutional framework was therefore illogical and guaranteed https://t.co/BubbudBuIO

International involvement itself was an implicit recognition that the Tamil national question could not be resolved within Sri Lanka’s existing constitution.

This deliberate disruption of power symmetry fatally undermined the negotiations and contributed directly to the collapse of the peace process.

Successful peace processes require relative parity between parties. However, international actors allowed the Sri Lankan State to freely import arms while effectively preventing the LTTE from doing so.

•In this article, Erik Solheim notes that when peace talks began in 2002, the LTTE was at the height of its power. That power symmetry between the LTTE and the Sri Lankan State was precisely what made negotiations possible.

High Commissioner's recommendation that #lkaratify the Rome Statute demonstrates the international community's realization that int'l justice forums, including the @IntlCrimCourt(#ICC), are the only places Tamil victims can get #justice. #RanilWickramasingheArrested@volker_turk

for #Accountability for #genocide, #CrimesAgainstHumanity & #WarCrimes. Financial crimes & grave crimes cannot be conflated. As history has shown, pervasive entrenched Sinhala chauvinism permeates the Sinhala polity, who will never allow #justice for Tamils. The @UNHumanRights

TGTE calls on the @UN #HumanRightsCouncil to bear these facts in mind at its session next month & not let Sri Lanka cite the arrest of Ranil for corruption as reason to think SL has changed & fool the #HRC into thinking new SL gov has created domestic space
