Some people on this platform are posting that Justice Sotomayor opinion’s tonight, denouncing—in dissent—nitrogen-gassing, is really strong. I beg to differ. Could have been a lot stronger actually in my opinion.
I remember when things were simpler to discuss—though no less horrifying—before this evening and Alabama’s 7th nitrogen-gassing-torture (and the nation’s 8th). Still pardon my abundance of posts on this topic lately—I know it’s a niche subject of interest.

Today, the United States Court of Appeals for the Eleventh Circuit refused to stay Alabama’s 7th nitrogen-gassing-execution torture on 10/23, affirming a federal district court’s decision that 2 to 7 minutes of conscious suffocation would not establish an 8th Amendment violation.

Unless Governor Kay Ivey or the Supreme Court intervenes—they won’t—the 2nd poor Black man in Alabama will be tortured to death Thursday by being forced to inhale nitrogen. Demetrius Frazier, a former client of mine, was the 1st Black man gassed to death with nitrogen in Alabama.

Today, the global community marks the 23rd World Day Against the Death Penalty. If you believe in the #deathpenalty, I’d urge you to reconsider but I hope you can at least agree gassing human beings to death is wrong. This weekend I’ll publish another essay—in Alabama—about this.
In 15 days, Alabama will torture a 7th man to death with nitrogen gas. Weird how the social media outrage hasn’t extended to repetitively torturing people with nitrogen gas.
