Party discipline is generally so rigid in New Brunswick that disagreeing with a motion to adjourn the house may be viewed by some as a revolt or a rebellion causing an election. This is very silly and not an accurate reflection of the constitutional order. #nbpoli.

Air Canada is legally required to cover out of pocket costs and accommodation for flights from Europe or any international flight covered under the Montreal convention. Air Canada isn't required by law to offer this on domestic flights as it is considered outside their control

The Board did give a deadline of noon EDT for the union to inform its members that the authorization to strike was revoked. Presumably at a certain point, the Labour Board would agree that asking the Courts to enforce its order would "serve a useful purpose" per s.23 of the Act

Presumably @AirCanada asked CIRB to file the return to work order with the Courts, however the board declined to do so per s.23 of the Labour Code:. Despite finding the union does not intend to comply, enforcement of the order does not serve a useful purpose at this time #cdnlaw

Folks may wish to review s.23 of the Canada Labour Code which allows the federal Labour Board to request that a Court enforce a decision or order of the board. This would take time. CIRB appears to not have a mechanism to enforce their own orders in relation to s.107. #cdnlaw

This may expedite aspects of the Courts determining whether the Minister can unilaterally direct the Labour Board to end strikes via section s.107. If the Courts find that there is no such power, then no fines can be levied against the union. A rule of law principle #cdnlaw.

Recall: the Minister cannot order an end to the Labour dispute. They are directing the Labour Board to order an end to the Labour dispute. As the CIRB has not issued the order, the Labour dispute can still continue for now. Presently a Schrödinger's cat like situation #cdnlaw.

What the writer doesn't appear to realize is since the start of their flight to Ottawa originated in the United States regardless of stops in Canada, Air Canada would be liable for damages arising from the delay up to a maximum of $8,142.18 Canadian under the Montreal convention.

My prediction: the Courts will find that the use of s.107 for the Minister to direct the labour board to order binding arbitration to end a labour dispute is both unconstitutional and exceeds the statutory purpose of s.107 as it makes back to work legislation moot. #cdnlaw.

For example in Moncton Dieppe, there are almost no forested provincial Crown Lands. 👇All provincial crown land is shaded Green. The forested crown land is an even smaller amount that includes the traffic circle by the Champlain mall. I encourage @JCCFCanada to review a map.

The vast majority of Forested Crown Lands in the Province are located in remote areas where people do not live. New Brunswick's response is proportionate and does not impact private forested areas or municipal forests or trails. I encourage @JCCFCanada to review NB laws #nbpoli.
