A software update will be required.
Nintendo notes that online play may be permanently shut down in the future if it continues to be difficult to keep the services running.

The servers for these games may have been taken down due to “ENLBufferPwn”, a vulnerability in the games’ netcode which allows a hacker to take over your console just by connecting to them in online play.
We will see when the updates are released.

My interpretation of Nintendo’s statement:
If another exploit is found, they are not going to fix it and will just immediately shut the servers down.

All of the eShop download servers are still up. It’s only the ability to browse the eShop storefront and make purchases which were disabled.

The affected code is in the game itself, so it will most likely be a game update.

Taking the LBP approach of server shutdown sucks. I get that shit happens and it's not financially worth it but still sucks to have it maybe die overnight.

Yikes, glad they're back but the fact they could be immediately shut down forever at a moment's notice scares me. Does Splatoon have any fan servers?

Surprised they decided to keep them up, felt like that was their perfect excuse to keep them close, but hey, they're finally back online!
