There's a reason why justification is a defence. The nature of defamation is that it protects reputation so if you don't have it ab initio, what will you protect? That notwithstanding, if you defame an olosho by calling her a thief or vice versa, defamation can come in.
I think this is subjective. Regardless of my reputation, the law should protect me. Oloshos, thugs etc should have their rights and persons protected. The fact that I’m a thug doesn’t mean I can be defamed and I won’t have a right of action.
