4) to win legally, I would think you have to show that paywalls were broken or that actual copyrighted material was repeated. One case IIRC did win because of this. Generally, LLMs are hardened against directly displaying copyrighted material.

3) I am all for making sure humans have jobs and that some jerk can’t go “draw X in the style of this living artist who I won’t pay.” But we would never want transformative use as a principle to go away. It would be disastrous.

2) We, as humans, literally do this all the time when we read books or study art from the library or store shelf or wherever else and then create our own art by accessing our memories of the material. AI just does it at hyper speed.

Transformative use of copyrighted material isn’t piracy. It astounds me that so many legal “experts” aren’t getting this and a layman like me was able to predict at least one lawsuit outcome (Anthropic) with that one sentence.

The Anthropic court case outcome does not surprise me - a few of us engineer-types were warning people this would happen. Transformative use is a thing and it’s in our interest to keep. I’m all for making sure our art still makes money, but that wasn’t / isn’t the way.

Jovial pasta’s brown rice fusilli seems to come in two different shapes, even though the boxes are identical. The kind from Whole Foods Market is thicker and more like rotelle (a good thing). I wonder why this is?.
