Texas Senate Bill 840 allows multifamily and mixed-use housing to be built on properties zoned for commercial, retail, office, or warehouse uses. Cities are attempting to circumvent that law by adding outrageous requirements for home builders.

“Cities don’t get to pick and choose which state laws they follow,” Matthew Chiarizio, a senior attorney for the foundation, said in a statement Wednesday. “For too long, Dallas has piled unnecessary and duplicative regulations on its citizens."

Cities don’t get to pick and choose which state laws they follow. We filed a petition today suing the City of Dallas to void and bar enforcement of 83 separate city ordinances that are not consistent with state law.
