Congrats to the Min of Finance for this v. promising work! The report is released today, along with a systematization of responses to the consultation,an economic study on the digital markets in Brazil and a comparative cross-country study. Looking forward to reading all this!.

- Revise merger notification forms, including specific questions on the business models of digital platforms. - Consider adopting the ordinary procedure for merger cases involving large digital platforms with high user numbers.- Use the ability to challenge consummated mergers.

Group 2: - Update antitrust analysis tools, for continuous improvement of the analytical framework used by CADE to identify and assess competitive risks, including new theories of harm (This is already underway) and update the thresholds ​​for prior notification of concentrations.

And to conclude on group 1. granting CADE the power to conduct market investigations (Bravo!), cooperate with ANATEL for technical requirements and create an interinstitutional cooperation forum with other federal agencies for digital markets (👏).

This is complemented by CADE's competence to establish procedural & transparency obligations on designated platforms (Standardizing requirements of meaningful transparency is v important) & specialized unit for procompetitive interventions (Uk-style, no need for prior violation).

2 important highlights: (1) CADE as the designated authority, rather than ANATEL (which appeared in the previous proposal). Great! CADE is the most well-placed to undertake this type of analysis. (2) Regulation is UK-style, with bespoke (ad hoc) obligations, rather than DMA-like.

Let's see (1): "Establish a procedure for the designation, by CADE, of systemically relevant digital platforms" and "[. ] a procedure for CADE to investigate designated platforms and define, on a case-by-case basis and to the extent necessary, specific substantive obligations.".

1: New instrument for promoting competition in cases of platforms with systemic relevance for digital markets.2: Adjustments in the application of antitrust tools to platforms in general.Thus, proposing not only "ex ante" tools, but also incremental changes to competition law.

The list of recommendations is already up on the website of the Ministry of Finance: They are split into 2 sets of proposals.

And we are back just on time to announce to the world the results of our consultation on the ex ante regulation of digital platforms. Press conference starts in 15 minutes, and the consultation report is expected to be released today with some proposals:
