⚠ To lawmakers drafting #privacy legislation:  No law can prohibit “inferences.”  That would make “thinking” and natural human brain-patterns illegal. What can be regulated, however, are inferences that have a harmful or disparate IMPACT on consumers.  #gdpr #addpa #ccpa #cpra

#Privacy is just fundamentals: 1️⃣ Transparency: Be open with consumers. 2️⃣ Control: Ensure consumers have meaningful opt-in & opt-outs. 3️⃣ Protect: Make sure the data is stored safely need it. 4️⃣ Curtail: Only share data with appropriate 3rd parties. See #Transparency above.

Most folks agree for the #FTC to successfully pursue #privacy #rulemaking it must avoid the #majorquestionsdoctrine - which basically holds that agencies need clear Congressional authority before doing something. Last week’s decision RE student loans puts that in jeapordy.

#Congress isn’t serious about passing a federal #privacy law. This morning the E&C Committee will be having a hearing on #databrokers. Regrettably, all data brokers have been prohibited from testifying. Failure to engage industry will lead to bad bills that won’t pass #adppa
