Symmetry decision handed down this morning. Court holds a condition cannot be used to require dedication of a highway. The court considered that there is a fundamental difference between s106 and conditions. @RichardHarwood2 and I will be explaining all in a webinar on Friday.

The Corporate Plan sets out where the OEP’s focus will be over the coming year. This includes scrutiny of plans and measures: to reduce nutrient and ammonia pollution in the aquatic environment and to improve soil health.

The enforcement policy will be of interest to all public authorities who may be the subject of enforcement action including environmental review (‘ER’). It’s also relevant to those with the benefit of planning permissions as a successful ER could lead to a quashing order.
