In addition to being regulated by the CDSCO, medical devices in India are also subject to the provisions of the Drugs and Cosmetics Act, 1940 and the Medical Devices Rules, 2017. (6/7).

The CDSCO has established a classification system for medical devices based on their intended use and potential risk to patients. These devices are classified as Class A, B, C, or D, with Class A being the lowest risk and Class D being the highest. (5/7).

The New Drugs, Medical Devices and Cosmetics Bill, 2022 is currently being drafted and is expected to further strengthen the regulation of medical devices in India. However, it suffers from severe inefficacies which must be remedied. (4/7).

The Central Licensing Authority within the CDSCO is responsible for the grant and renewal of licenses for the manufacture and sale of medical devices in India. The CLA also conducts inspections of manufacturing facilities to ensure compliance with regulations. (3/7).

On February 11, 2020, the Ministry of Health and Family Welfare issued a notification stating that all medical devices intended for use in human beings or animals must be registered with the CDSCO before they can be sold in India. (2/7)
