But mostly, it's utterly demoralizing that 28 years after.#230 was adopted, to hear folks on the Hill claim (to me of all people) that they have to do something to chip away at #230. I'm like, yes, you DO, but that doesn't include passing a law that is even worse than #230. 12/12.

It's not clear to me why this language would somehow protect LGBTQ+ kids online -- in fact, if anything, it's quite the opposite. But what is clear: LGBTQ+ kids are one of THE MOST vulnerable communities online for grooming & having non-consensual explicit imagery shared. 11/.

Thursday, we started a petition, hoping to get 1,000 signatures from child safety groups, bereaved families & other concerned parents. By COB Friday, we had 10k signatures. It's clear: parents across this country are fed up with #BigTech & #Congress. 9/.

That's what Section 2255A says, in effect, but rather than the Catholic church hypothetical, it applies to platforms to which hundreds of millions of pieces of content are uploaded daily. Judiciary Staffers even told me they thought it was bad, but still stood by it. 8/.

"Imagine a world where. to hold the Catholic Church accountable, the bishop would need to know a child was being raped, & that he had 48hr to stop the rape. If the bishop did not know of each individual occurrence of child rape, the Church couldn't be held responsible." 7/.

Kids who have the worst moments in their little lives spreading on the web would have to prove that platforms knew about every piece of content to prevail, under the current language, or prove the platforms intended to spread their rapes and abuse. 6/.

What's hard for me to wrap my brain around is how U.S. Senators, including @DickDurbin @amyklobuchar @tedcruz @HawleyMO @SenMarkKelly who have spoken eloquently about the urgent need to protect kids from #onlineharms would then co-sponsor a law that does the opposite. 5/.

Section 2255A would also give tech companies a "get out of jail free" card if they use #encryption. Many of us expect passing this law will encourage more social media platforms to encrypt, so they can save money by looking the other way. 4/.

Let's be clear, most of #StopCSAM is good! And we .@counteringcrime hope it passes! But Section 2255A elevates the burden of proof for civil lawsuits to "actual knowledge" by the platforms, a higher standard than any other civil standard required of any other type of victim. 3/.

More than 28Y since #Section230 was adopted, #STOPCSAM has language that will make it HARDER for CSAM survivors to sue #BigTeach in civil court than it already is (yes you read that right). Yet somehow the bill made it out of the #JudiciaryCommittee. @Moonalice @cagoldberglaw 2/

Working this week with bereaved parents to try and get Section 2255A deleted from the #STOPCSAM Act, before it gets tacked onto the back of one of the end of year bills moving through Congress, makes me feel like my soul wants to leave my body. 1/.

Section 2255A also provides tech a “get out of jail free” card if they utilize encrypted technologies. This is a terrible idea- will encourage large platforms to encrypt their systems, in order to avoid the burden of having to search for and report CSAM on their platforms. 5/.

Placing the burden on plaintiffs to prove that tech platforms have actual knowledge about each piece of violative content, and/or indeed the intent for it to be there, will have cruel impacts for child sex abuse survivors. #CSAM #protectkids #BigTech. 4/.
