When you're in the national security world, trying to protect people, a domestic terrorism law akin to 2339B is a tempting prospect. But it's also extremely dangerous - imagine your political opponents getting the ability to designate any group and criminalize funding it.

Most people I've taught about terrorism prosecutions, both abroad and at home, don't understand just how strong our First Amendment is. In a lot of other countries, mere possession or broadcasting of pro-terrorist propaganda is a crime. In the US, it's protected speech.

Prosecuting domestic terrorism federally has always been tricky. Usually the best choice are gun laws, as their members are often already felons and usually have illegal guns. Second choice is interstate threats (18 USC 875) but that's a tricky one because of the First Amendment.

Designating organizations as Foreign Terrorist Organizations matters, because it allows the use of 18 USC 2339B to charge their supporters. Calling a domestic organization (whether Antifa is one is another matter) a major terrorist group does not create any new charging options.

DOJ's National Security Division and the FBI have always treated all kinds of terrorism equally, regardless of ideology. If someone had violent intentions and an ideological basis, it would be investigated by counterterrorism professionals.
