CA to hand down judg't this morning in ADP RPO v Haycocks on importance of whole workforce consultation to fairness of a redundancy when collective consultation under s188 NOT triggered. Is it nevertheless required by "good industrial relations"? #ukemplaw.

On 21 Oct the Employment Rights Bill had is 2nd reading & now at the Committee stage scheduled to be concluded no later than 21 Jan. We also got the first 4 related consultations and one related SI. For details see our updated tracker #ukemplaw

Published today Regs revoking the Regs which would have implements s6 REUL (permitting CA & SC to depart from assimilated case law). So s6 NOT coming into force on 1 Oct. Is this as significant as I think or am I missing something?.

Supreme Crt judgment in Tesco v USDAW on 12 Sept - Whether CA correct to overturn the High Court’s decision granting injunction restraining Tesco from ‘firing and rehiring’ employees in order to remove a ‘permanent’ contractual entitlement to enhanced pay .

Latest update on Employment Rights Bill from press reports (1) Bill now expected "mid-October" so presumably after return from conference recess (7 Oct) but we wait to see & (2) Right to Switch Off to be via Code of Practice

(1) NLW to not drop below 2/3rds of UK median earnings for workers aged 21 +.(2) The NMW rate for 18 to 20 year olds to remain from April 2025 but "to narrow the gap with the NLW taking steps year by year in order to achieve a single adult rate".

THE FORSEY SAGA: After nearly 9 years & a couple of visits to the SC, the prosecution of David Forsey under s194 TULRCA 1992 (failure to notify Sec of State of large scale redundancies) was dismissed on 23 February 2024 as "no evidence offered". #ukemplaw.
