PRC embassy in Japan is practically invoking Article 53 on the "enemy state" in the UN Charter to issue a veiled warning to Japan of military action that can be undertaken by any UNSC P5 members (Beijing included) without the Council's authorization. https://t.co/4eHhSh25eY

《联合国宪章》专门设立敌国条款,规定德意日等法西斯或军国主义国家的任何一国有再次实施侵略政策的任何步骤,中法苏英美等联合国创始成员国有权对其直接实施军事行动,无须安理会授权。

By so doing, Beijing just demonstrated why it's necessary to reform the UN, so that it becomes possible to rein in the P5 member states and prevent abuse of authority. It's appalling to see how far Beijing can go just to solicit Takaichi's retraction of her Taiwan comment. 🤷🏽‍♂️

The Chinese invocation of UN Charter rights to take prompt action should Japan’s re-militarisation threaten regional aggression raises an interesting parallel question regarding Russia and Germany. China was a founder to the UN with a Security Council seat as an Allied state

@CollinSLKoh 1. International law and the UN clearly treat modern Japan as a post-war democratic state, not as the “Imperial Japan” of WWII. Modern Japan is a distinct political and constitutional entity from Imperial Japan Except when its politically convenient for 🇨🇳

@CollinSLKoh 🇨🇳 treats UNCLOS obligations as optional, the 2016 PCA ruling as irrelevant, and its P5 seat as license to redefine the law and history. 🇨🇳 wasn’t even at the table when the UN system was created. They can’t claim leadership while disregarding the legal order they rely on.

@CollinSLKoh 2. UNGA Res 50/52 1995 explicitly declared that the “enemy state” provisions: have become obsolete and should be deleted from the Charter. Intl law scholars state that Article 53(2): No legal validity, Can't be relied on by any mbr state A historical artifact of 1945.

@CollinSLKoh WWII still shapes relations in Asia. Japan-China diplomacy feels the weight of the UN Charter and history. Strong ties and old rivalries definitely make today’s security talks more complex.

@CollinSLKoh #2. For Asians (& Singaporeans) to support Jap despite their WW2 atrocities & refusal to atone crimes, they are usually: 1. bastards borned by women raped by Japanese (many such in Taiwan & SG etc) 2. Received handsome $$$ from Japanese to white-wash their atrocities! Which r u?
