We urge the Dutch appellate court to recognize that privacy tools are legitimate, that code is speech, and that punishing builders for code they no longer control endangers the fundamentals of open, permissionless innovation. Full report here:

Finally, we state the principle plainly: “Software developers should not be held criminally liable for the actions of third parties who use their software to commit crimes.” Holding otherwise jeopardizes every open‑source project.

It puts the risk in perspective: “Neither Ethereum nor Tornado Cash requires users to trust intermediaries, and neither allows any third party to control the user’s tokens while transacting.” Open systems protect users by design.

The report dissects how Tornado Cash works: immutable smart contracts, user‑controlled keys, zero‑knowledge proofs, and optional third‑party relayers—none of which give the builders custody or control over anyone’s funds.
