… And, finally, brilliant to see my former mentee Emma Colebatch @1GCFamilyLaw appearing pro bono at the final hearing (instructed by @irwinmitchell also pro bono), and earlier work by Lucy Maxwell ensuring the mother was represented through the remitted process.

… And something of a cautionary tale about the shoehorning of appeals to send a message (to correct a “misunderstanding”) — at the time it appeared a somewhat heavy handed intervention, and on the specifics of this case, at the very least, hasn’t aged especially well …

… at least open to question. Not to say that the complaints have legs — the Judge may well be right — but curious that everyone proceeded on a seemingly erroneous basis. 4/4

Interesting case, and some deeply unpleasant conduct on the part of the father. I’m not sure that the Judge’s analysis regarding the making of complaints is built on a firm foundation (which is problematic given that the Judge considered referring the case to the AG … 1/4

So... I WON my appeal against an order made unlawfully by HHJ Haigh in Manchester family court on 22 August, restricting reporting of purely process matters that I had applied to be able to write about. Judgment here

… King LJ noted in H (A Child) ( https://t.co/3QjB4OBQ7g) (paras 92 - 94) that the approach to private law vaccination cases may need further examination, it’ll be interesting to see how this develops as C-19 (and other) vaccination applications come before the Family Court /end

… the need for 2 parent approval dates back to the decision of the Court of Appeal in Re C in 2003 ( https://t.co/LR5GZ7mYZV) which has been followed subsequently … but it is not clear at all that Thorpe LJs observations were part of the ratio of the case /3

… the key question for the future is whether, as is the case in public law vaccination cases, the balance should now shift to favour the parents pursuing vaccination given the numerous decisions endorsing vaccination emanating from the Family Court /2
