Funds remaining in the litigation recovery account will be utilized to maximize returns for creditors under the plan, including by continuing to, among other things, prosecute, settle, or otherwise resolve certain claims and causes of action.

This distribution reflects the achievements of the Litigation Administrators and the Litigation Oversight Committee to date and represents over 200% of the funding from the initial funding that was provided under the chapter 11 plan to pursue certain causes of actions.

The Litigation Oversight Committee and Litigation Administrators have allocated more than $125 million from the litigation recovery account to be distributed to eligible creditors subject to certain holdbacks in accordance with the chapter 11 plan.

Since the limited-time settlement offer was announced on March 20, 2024, nearly 2,000 Celsius account holders with withdrawal preference liabilities accepted the settlement offer, totaling approximately $110 million in settlement value to date and accounting for the resolution of.

In July, the Litigation Administrator commenced litigation against certain Celsius account holders who had not already settled and had a net withdrawal of more than $100,000 during the 90 days prior to Celsius’ chapter 11 filing.

Following a successful hearing on October 8, 2024, the Litigation Administrator announced the 13.75% settlement offer will expire on at 12:00 pm ET on October 29, 2024.
