Good public records opinion from CA 4th District – privately-run immigration detention facility operating under a local gov contract is subject to CPRA, even if the private prison corp isn’t a party to the contract. (also my first appellate win!).

Assertive language in an initial email from a potential client isn't a deal-breaker for me, but it's something for potential PRA clients to think about. My advice - focus on communicating the facts and your goals, steer clear of legal conclusions.

AI issues aside, when a client tells me their PRA case is a "slam dunk" or the agency is "blatantly" violating the PRA - that doesn't tell me anything about the actual strength of the case, but it does make me wonder whether the client will be open-minded to my analysis.

I don't like when potential clients use ChatGPT to draft an initial email to me. I get why someone would do it, but AI tends to use very assertive language that makes the client sound overconfident about legal issues and the strength of their claim.

Should be interesting to see results of PRA/FOIA requests for communication between Fed and local gov in the new Trump era. Pro-tip: submit requests to each agency involved in the communication - it's always interesting to see how different agencies respond to the same request.

A few years ago, the legislature changed all the CA Public Records Act code sections, but plenty of helpful resources – and, of course, cases - still have old code citations. Here's a helpful table of old v. new code sections for quick comparisons! .

Public records tip: if the records relate to public business but the agency says they held by a private, third-party contractor - see what the contract has to say about it. You can often find contracts on the agency website, or you can request it via PRA.

CA public records tip: . Agencies have to produce records “promptly.” But what's "prompt"? There's no clear rule and it can depend – i.e., are you requesting 1 record or 1000? . When drafting your PRA keep in mind that more complexity may justify a longer production time.
