4. A related loophole allows developers to reduce the number of IH units from 15% to just 10% by opting out of additional subsidies when offered. The draft regs do this by replacing mandatory "shall" of statute w/ "may." Theres more shenanigans but these are some highlights. 4/.

3. The draft turns the minimum IH requirements from a floor (as specified in IH law) into a ceiling by capping IH apts at 15%. This will block City from negotiating more units in return for big subsidies, like the $660 #PortCovington TIF that requires 20% per the old IH law. 3/.

2. Other loopholes make voluntarily low-income full-time students eligible for IH apts & allow subletting bedrooms. Both are against rules for all other subsidized housing & invite fraud. And it disregards that IH law already deals w/ students by exempting student housing. 2/.
