According to a decision by the Austrian Data Protection Authority, Microsoft installed cookies on a student's device illegally. Both the school and the Austrian Ministry of Education stated that they were unaware of the tracking prior to noyb's complaint. https://t.co/lVB5hQxf7M

🇩🇰 The #DK #DPA also states that, because the website (unsurprisingly) changed since #2022, they will not investigate the matter further. 🍪 This disregards the possibility that the complainant's #data may still be processed illegally, which was neither checked nor remedied.

Insgesamt hat AZ Direct aber mehr als 7 Millionen Datensätze an die CRIF verkauft. Es ist aktuell völlig unklar, woher CRIFs größter Datenlieferant seine Informationen bezieht – was es auch unmöglich macht, seine DSGVO-Rechte auszuüben.

Bei AZ Direct ergibt sich unterdessen ein ganz anderes Problem: Der Adresshändler hat trotz gesetzlich verankerter Auskunftspflicht bei fast keinem der 2.400 teilnehmenden Personen konkrete Datenquellen bereitgestellt.

Auch das bekannte EuGH-Urteil zum “Recht auf Vergessenwerden” betraf rechtmäßig veröffentlichte Daten, die aber von der Google-Suche nicht einfach weitergenutzt werden durften.

Die österreichische Datenschutzbehörde (DSB) hat in Bezug auf das Grundbuch bereits entschieden, dass z.B. eine Weiterverarbeitung für Werbung gegen die DSGVO verstößt.

Es ist nicht nur offensichtlich, dass diese kommerzielle Weiterverwendung nicht im Sinne des öffentlichen Interesses ist, sie verstößt wohl auch gegen den DSGVO-Grundsatz der “Zweckbindung” in Artikel 5(1)(b) DSGVO.

Eine neue Auswertung im CRIF-Fall zeigt: Die Adresshändler Compass-Verlag und DPIT greifen auch auf öffentliche Register wie Grund-, Firmenbuch und Vereinsregister zu. Woher AZ Direct die Daten von 7 Millionen Menschen in Österreich hat, bleibt unklar. 👉
