KEY: Hippler adds that under Idaho law, "When a defendant waives their right to appeal, it doesn't mean they don't have a right to appeal. ".

Some redacted items will never be unsealed, including personally identifying information about minors and victims.

This gives him time to review them individually, and he says he is more familiar with the filings made after the change of venue put the case in his courtroom.

He says he plans to unseal documents in batches, starting with the newest filings, moving back in time toward the start of the case.

Hippler says lifting the gag order does not lift his previous preservation order regarding the Dateline leaks earlier this year. It also does not unseal sealed documents. He is denying a separate motion to unseal almost 250 secret documents.

He notes that lifting the order doesn't compel officials who don't want to speak to speak. Prosecutors have already said they won't until after sentencing.

"I do not believe the purpose of the non-dissemination order. the primary purpose. is any longer at play." -- Judge Steven Hippler. He says lifting it will not meaningfully impact the defense's concerns.

Kohberger's defense opposes this, in part because someone leaked something to Dateline in May. And also because of 'the ongoing publicity regarding the case and threats to Mr. Kohberger's safety.'
