I’m not sure Baker understands
#NIL
agreements cover a wide range of products and services.
So can’t have a uniform NIL agreement.
It seems like he’s treating NIL agreements more like pro sports employment agreements.
In that case, would need to be collectively bargained.
New NCAA President (and former Governor of Massachusetts) Charlie Baker says he wants "consumer protections" around NIL, saying he's "gonna talk some with the folks in Washington."
Charles Barkley responded, as only he can.
I’m also getting tired of hearing him repeat the line that the only thing true about
#NIL
“is that everyone lies.”
Just because one AD (who probably has no first hand knowledge of the NIL market) told him that it doesn’t make it true.
It’s just not the case at all.
@WinterSportsLaw
Services would need to be customized for sure (and special provisions related to those services) but you don’t think we could find a uniform starting point for indemnity, termination rights, payment, etc.? Bad presentation of the idea for sure but I can see some value in this
@JAFerrari44
Sure, it would be fine for some terms. But there’s no way they can force everyone to use a template outside of a federal law or collective bargaining.
Can’t see a federal law dictating this.
@WinterSportsLaw
Make them all employees since everyone is eager for it. Utah Utes players will have to forgo all NIL to not be in violation of state employment laws. There will be others. But as least we can stop with the constant employee talk. Just screw athletes to make them employees
@WinterSportsLaw
College athletes need to unionize now or they’re going to be left with the crumbs. They need a seat at the table or they’ll get left out in the rain again.
