The court will reserve judgement and will await the new affidavit

Our final submission: we must not lose sight of what this complaint is about. The people who use transport, who struggle to barely make ends meet, those who face violence on an every day basis. This is the context of these complaints. Real people’s lives!

Comp: If a member of Parliament had resigned and has after the fact been found guilty, they may still be sanctioned as was the case with Boris Johnson. The case should be completed while it is still ongoing as delaying it could compromise it.

The affidavit will be sent and considered by the bench after-which they will submit a verdict. The #UB is now responding to the respondent.

Resp: the matter is one of legality not PAJA

Resp: the fact that a legislation is abused does not make it unconstitutional

Resp: The code started to be revised before the legal proceedings had begun.

Resp: Absent the affidavit, this issue is not before the high court, but would have to be filed with the Constitutional Court

Important Question: Under what circumstances could these meetings be opened?

Bench: Practicality cannot overrule the joint rules of the constitution.

Bench: what the constitution requires is that reason must accompany an exclusion, but the rules as they stand lends to the opposite

The National Assembly may not exclude the public unless there is a reasonable and justifiable cause. (constitution)
