For the second time in a year, I found a @CelebrityCruise I wanted, but Celebrity would not let me book the cabin I wanted as a solo cruiser. So for the second time, I'm taking my business to another cruise line that respects solo travelers.

Fed up with @CelebrityCruise and won't sail them again for the way they hate solo cruisers. Looking at a cruise 7 months from now. If I try to book 2 people it gives me great room options. If I say 1, it shows me lousy options. This has happened time and again. No more.

Quoted by the Editor of The Indiana Lawyer about the law of public employee free speech rights.

Public employees are learning that comments they make on social media, even on personal accounts, can end careers. But the courts still have a chance to sort out when such firings are unjustified.

I have this op-ed in today's Indy Star. (I didn't write the headline and subheads, and they're hotter and more definitive than I intended the article to be.)

Universities can't fire employees just because politicians don't like what they post on social media.

Cases like this depend on facts found by a court, so it’s early, but right now I’d predict @BallState will get spanked. The precedent they relied on is not a good fit to this situation. @PresidentMearns, a lawyer, should have known better.

Ball State fired an employee last week after finding her Facebook comments were "inconsistent with the distinctive nature and trust" of her role.

Across the country and here in 21Country people have been posting about conservative activist Charlie Kirk’s death.

2/2 Ball State recites this rule, but it's not immediately clear why someone whose job was "health promotion" and who makes pointed comments about Kirk necessarily disrupts the university's business. The fact some people might be upset is not enough.

1/2 Under the First Amendment, government employees are allowed to speak freely on public matters unless their employer can demonstrate that the speech significantly interferes with their ability to carry out their functions.

.@IUMaurerLaw hosted a terrific conversation for Constitution Day between Brad Jacob of Regent U School of Law and Alan Trammell of Washington & Lee. It was a great example of @acslaw and @FedSoc chapters joining together to sponsor a program for the whole community.

There is no serious theory under federal law that would allow prosecution of the store or the employee. This looks like pure intimidation of people who will believe this sort of power exists.

The attorney general’s “hate speech” comments were a mess. Her line on an Office Depot employee with personal objections to Kirk made the mess worse.

Quoted by IU Newsnet about IU's free-speech ranking from FIRE. My brief comments (at 3:50) express caution about placing too much weight on a non-scientific ranking based on high-profile events and self reports.

On the first IU NewsNet of the semester, we have reaction to the murder of prominent right-wing activist Charlie Kirk who was to appear at IU next month. Now, a Dunn Meadow candlelight vigil is...

IU trustees step toward transparency, despite possible violation

The trustees held a rare public committee meeting, but earlier this month they may have violated Indiana's open door law.

The influence of new trustee Jim Bopp is becoming apparent. Bopp is an advocate for greater transparency on a board that was accustomed to acting like a secret cabal. If they even had a nominating committee before, it never met in public and announced its business in advance.
The IU Board of Trustees is meeting on Zoom Monday to vote on officers. The Nominating Committee is recommending surgeon David Hormuth as chair, likely ending Quinn Buckner's role as the group's leader. @WFIUWTIUNews . Agenda here:
