This is a basic misunderstanding of the 14th Amendment. "Subject to the jurisdiction" means owing political allegiance to the US and being owed the protection of the US Constitution. The 14th Amendment does NOT guarantee citizenship to children born to parents who are here.
This is what gets me every time. MAGA Republicans claim immigrants aren’t “subject to the jurisdiction” of the United States so the Constitution doesn’t apply to them — no birthright citizenship, no due process. But here’s the fatal flaw:.If they truly weren’t under U.S.
