SAG ACTORS:
I want to talk about AI and how it will affect you.
I’m a former SAG Board Member and former SAG Negotiating Committee member.
I’m also WGA and DGA. 1/
#SAG
Actors, I want to make you aware of some of the language in the
#AI
portion of the tentative SAG agreement.
Though SAG leadership made much effort to protect members in AI, there are many issues you should look at. I have saved the most serious issue for the end. 1/
Being in a union, and going on strike with it, is the type of thing that’s become unfashionable in society. It means you are sacrificing for others; committing to something bigger than yourself; putting in effort because those in the past did it for you, & now it’s your turn. 1/
Got this email, re: the cancellation of

The reality about this:
ACTORS, you must tell your agents to LOOK at the indie film offers. They are now so used to streamers throwing money at them for you, that your agent won’t even look at smaller indie offers. YOU ARE BEING OFFERED THESE INDIE FILMS. You just don’t know it.
How about we all jump into indies now? Content creators create a film & TV-making system alongside the studio & streaming networks? So there is actual competition. 🧵
Addendum: Actors, you must have iron-clad protection against the AI use of your image and voice in the SAG MBA or your profession is finished. Demand it from
@sagaftra
and do not accept any AMPTP proposal that does not have it.
AI has to be addresses now or never. I believe this is the last time any labor action will be effective in our business. If we don’t make strong rules now, they simply won’t notice if we strike in three years, because at that point they won’t need us. 10/end

I will be taking the actual deal document (and not the “summary” SAG is planning to release) and explaining the violating

issues. 1/
What does it mean to be part of a union? If it’s on strike, you stop work, and picket. You get to enjoy the gains past members fought for, and then you fight for future gains.
And you don’t break.
You don’t break.

Being in a union is one of the most fantastic opportunities in life, to have the chance to stand up for the group, for the strongest and the weakest alike. What a magnificent experience in which to participate.

You are a complex & remarkable human. Don’t let the CEOs convince you otherwise. Seek out filmmakers & showrunners who value your basic worth & committed to human workers on their projects. These are the ones who will make work that matters. We’re going to be OK. Just hold on. /
.
@SenSchumer
, your “AI meeting” yesterday was greatly dominated by those in tech who benefit from no legislative restrictions. We would like a second meeting, populated with the people and professions that will be destroyed by generative
#AI
. This is the correct thing to do.
The AMPTP not only wanted to own background actors specific likeness forever, but wanted to feed 100 YEARS OF ACTING PERFORMANCES (for a nominal fee) to train the GAI models. So all our work could be frankensteined into “new”
#AI
characters. And NO consent from any of the actors.
“They think human beings who are are not of their socio-economic class are just another natural resource… to be managed, to be utilized. Maybe exploited, but mostly… managed. Because they always say stuff like, ‘Those people are asking for too much.’” Well, we’re not. 2/fin
It may be new terms that affect only the newest of the union’s members, or the part-timers, or the elders, and not necessarily you, specifically. But that’s not the point. “You” are not the point. ALL of you are the point. The union, the members as a whole, is the point. 2/
If you show up to be an audience member of a talk show and see picketing union members outside, have some self-respect and do not cross a picket line. You’ll be a better person for it.
#WGA
SAG Actors: have you recently been presented with a contract that gives the employer rights to your image/voice for not just that project, but for any future project at all, in perpetuity? Screenshot that portion only and tag me.
“It’s beyond fake. That is an amalgamation of a bunch of images and footage that they stole for artists. Plain and simple generative AI is complete and utter theft,” says
@JustineBateman
on
@OpenAI
’s Sora.
Why are we not hearing about the studios / streamers suing large video generative
#AI
companies and making them delete their training sets because their copyrighted films/series are in there?
Because they want it to get out of control. The reason? 1/
We are NOT fucking “creators.” We’re not shaking our asses on TikTok. We are filmmakers: directors, writers, cinematographers, etc.
The last owner of Warner Bros decided to delete Film Struck, and it was a clear indicator of their hate of filmmakers. Don’t make the same mistake.
I’m really proud of the
#SAG
Negotiating Committee and SAG leadership for standing their ground. The last AMPTP
#AI
proposals were horrifying, treating actors as if they had no say in the manipulation of their own image and voice. Their disrespect for actors is hideous.
Needless to say, no
@IATSE
crew members, no
@Teamster
drivers, and no
#DGA
directors will be needed. At first these efforts will be run by software project managers, and eventually even they won’t be needed.
Studio/Network/Streaming Executives & stockholders, you may want to think of ways to change out your CEOs. It does not appear that they understand what is going on right now in the business. Not negotiating with us is going to walk your companies right off a cliff.
#AIwillEatYou
The NYT did a puff piece on the lead negotiator for the studios & companies this morning. I didn’t learn much, though they did confirm she has a bizarre idea of what negotiating means. We’re fighting for the existence of our careers. She wants us to “soften our stance” on that?
… employed under Schedule F.” It appears that if you were paid Schedule F for the first film, you don’t get paid for the sequels, where they’re just using your digital double instead of you. I suggest members get sharp clarity on this. 6/
Jesus Christ. Warner Media stockholders, if you want to protect your money, get CEO in who knows films and the film business and wants to make great films/series. Someone with a “vision” that has to do with that and not with M&A and stock price. 1/
If a “digital double” is made of you during a film, they must get your consent and inform you of their intentions for its use, EXCEPT "when the photography or sound track remains substantially as scripted, performed and/or recorded.”2/
This is going to be left up to the studios/streamers’ interpretation. And so, any subtlety regarding how you chose to look or move for the character during the shoot could potentially be changed. Your hair, your clothes, your make-up, etc. 3/
@Teamsters
I find it baffling that a union representing human actors would give approval of those same actors being replaced by an AI Object. And don’t forget, those AI Objects are a mash-up of all actors' past performances, adding insult to injury. 18/
1. AI-written scrips & digitally-scanned actors (image and/or voice). Both already exist. Some talent agencies are actively recruiting their clients to be scanned. You choose the projects and get 75 cents on the dollar. 3/
But while writers and directors have multiple scripts/directions, actors have just ONE face/body/voice. Once their body movements, voice, gestures, and essence is freely put in the AI blender, our business is all but finished. 3/
6. Training an AI program on an older hits TV series, and creating an additional season. FAMILY TIES, for example, has 167 episodes. An AI program could easily be trained on this, and create an eighth season. We only shot seven. 9/
It’s one thing to use GAI to make a King Kong or a flying serpent (though this displaces many VFX/CGI artists), it is another thing to have an AI Object play a human character instead of a real actor. To me, this inclusion is an anathema to a union contract at all. 16/
Also, your physical placement in a scene can be changed, like your nearness or distance from another character, or even moving you from the front seat of a car "to the back seat of the car." This suggests not much agency on your part to control your character or performance. 4/
3. Films “ordered up“ by the viewer. For example, “I want a film about a panda and a unicorn who save the world in a rocket ship. And put Bill Murray in it.” 6/
This is akin to SAG giving a thumbs-up for studios/streamers using non-union actors. This would be like the
@Teamsters
putting in their contract that it’s A-OK for the employer to utilize self-driving trucks instead of them. 17/
Neither consent nor compensation is necessary to use your “digital double” if the project is "comment, criticism, scholarship, satire or parody, a docudrama, or historical or biographical work.” So, you could find yourself in a project you never consented to… 9/
Those famous actors will have zero protections over that, without a firm SAG restriction on
#AI
training.
So, on the eve of returning to AMPTP negotiations, now is the time for famous actors to voice their dissatisfaction with zero consent or compensation for AI training. 5/
@Teamsters
Bottomline, we are in for a very unpleasant era for actors and crew. The use of “digital doubles” alone will reduce the number of available jobs, because bigger name actors will have the opportunity to double or triple-book themselves on multiple projects at once. 19/
Ryan brings up a good point. Make sure there’s a provision in your contracts where if the company goes bankrupt or wants to sell its assets (including their library of “actor scans”), the rights to your
#AI
“digital double” reverts back to you.
5. Licensing deals made with studios so that viewers can order up older films like STAR WARS and put their face on Luke Skywalker‘s body and their ex-wife‘s face on Darth Vader‘s body, etc. 8/
Under “(Digital Double) Use Other Than in the Motion Picture for Which the Performer Was Employed,” it says that "No additional compensation shall be required for use of an Employment-Based Digital Replica that was created in connection with employment of a performer who was… 5/
@Teamsters
@IATSE
@Teamster
Audition odds will change. Winning an audition could become very difficult, because you will not just be competing with the available actors who are your type, but you will now compete with every actor, dead or alive, who has made their “digital double” available for rent … 21/
The most famous actors have the greatest risk here. The prompts are going to be (or continue to be) “Give me a female character who looks like Jennifer Lawrence & Megan Fox, moves like Meryl Steep in SILKWOOD, dances like Ginger Rogers, with a Penelope Cruz accent,” etc, etc. 4/
…doing things you never were informed of, for no compensation at all. This is the “First Amendment” argument the
#GAI
tech companies are fond of trotting out. 10/
I’ve been in the business for over 40 years & I’ll tell you what bothers me the most about the AMPTP’s (studio/streamer) position now. They shifted from being proud to be associated with great films/series to being put-out that “their workers” aren’t just filling “their shelves.”
2. Films customized for a viewer, based on their viewing history, which has been collected for many years. Actors will have the option to have their image “bought out” to be used in anything at all. 5/
And the most serious issue of them all is the inclusion in the agreement of “Synthetic Performers,” or “AI Objects,” resembling humans. This gives the studios/streamers a green-light to use human-looking AI Objects instead of hiring a human actor. 15/
If a “digital double” was made of you in a separate manner (on another film or privately made by you), it's referred to as an “independently created digital replica” (ICDR). There is no minimum compensation listed for studios/streamers to use an ICDR of you in… 7/
If you show up to be an audience member of a talk show and see picketing union members outside, have some self-respect and do not cross a picket line. You’ll be a better person for it.
#WGA
As of now, there are no entertainment union restrictions on generative
#AI
models ingesting 100 years of films/series, slicing and dicing them, and then popping out patchwork spoonfuls of all that work.
I assume the AMPTP is going to try to pattern-bargain that on SAG. 2/
Parents of art students at Art Center College of Design in Pasadena, this school is apparently teaching your kids how to “prompt” generative
#AI
programs instead of art lessons you’re paying for. I’d contact the Dean and ask for some money back.
@artcenteredu
A funny thing just occurred to me. The studios/streamers now have access to
#AI
tech powerful enough to replace us, and yet they STILL can’t do anything without us, because that tech doesn’t function without being fed our work.
They can’t make anything on their own. Even now.
Here are the
#AI
basic needs for a
#SAG
agreement, from my perspective. (I have not been in the room lately, so this is not reflective of any recent proposals or counterproposals.)
1. Definition of someone playing a “human character” must be an actual human. 1/
@Teamsters
@IATSE
@Teamster
… in a range of ages to suit the character. You also will be in competition with an infinite number of AI Objects that the studios/streamers can freely use. And a whole cast of AI Objects instead of human actors eliminates the need for a set or any crew at all. 22/

“Fair Use” is a bullshit generative
#AI
company argument for scraping all of our copyrighted work. If your tech can’t function without our work, then it can’t function at all. Thank you
@CopyrightOffice
for looking at this very serious issue.
Only when the
#WGA
makes an announcement, will there be news on negotiations. Everything in the media now is merely speculation and spin.
All that is true today is that the WGA Negotiating Committee asked us to flood the picket lines today, and so we will.
@WGAWest
@WGAEast
The substitution of swear words is not new, but that your “body movements” would be changed suggests you’ll be used like a type of rag doll in post-production. 12/
AI is being used to replace human expression for the sake of greed. The
#WGA
fight can become a template for other industries. I’ve heard of paralegals being replaced with ChatGPT at a legit law firm, & medical grad student being replaced by ChatGPT for medical research. 1/
…the minimum rate for a performer… had (they) performed those scene(s) in person.” So, if an extra is “bumped up” to a principal cast member, they never get to experience that position on a set. But you get a check after the fact. 14/
As a
#DGA
film director (& member of the DGA W Dir council), I’m dismayed to see some of my DGA brothers and sisters in so much fear. Regardless, I will continue to fight for the protection of your work and the work of past directors/ADs/UPMs from the abuse of generative
#AI
.
Prominent Directors Guild of America member Linda Montanti openly advocated against the election of 10 writer-directors to the guild’s board earlier this month, including Boots Riley, Justine Bateman, and Craig Mazin.
Background Actors: I’m collecting stories of instances where you have been scanned and signed agreements for films/series, for your image to be used now and in the future. Reply with your stories, please.
Another consent exemption is granted to "adjusting lip and/or other facial or body movement and/or the voice of the performer to a foreign language, or for purposes of changes to dialogue or photography necessary for license or sale to a particular market. 11/
Every move the AMPTP makes leads you to believe they not only hate labor, but human capital itself. In fact, they appear to hate films and series, too. The only thing left is money. The love of money.
There are still a few concerns with the Background Performers’ details, but there’s one that stands out as especially sad. "If the Producer uses a background actor’s Background Actor Digital Replica in the role of a principal performer, the background actor shall be paid… 13/
And the thing about
#AI
replacing the arts is that it will have a devastating effect on society. Talented artists are tubes through which God, or the universe or magic or whatever you want to call it, comes into society. It is profound. 2a/
In

This is shit. I’m embarrassed for this legendary band. Nothing was “created.” Artists’ work was stolen to train this computer program, that someone promoted to spit out a Frankenstein spoonful. Pink Floyd should use actual art made by an actual artist.

SAG ACTORS,
Vote yes on the coming strike authorization so the leadership has the most ammunition to protect you from the dehumanizing act of giving away the representation of YOU.
Don’t let the AMPTP treat you like some object they can use however they want.
I’ve said from the beginning that the use of generative
#AI
will collapse the structure of this business. I want the actors and crew to have enough self-respect to turn over a table and flip the CEOs off as it happens. They’re going to leave you with nothing left to lose. 4/
#AI
doesn’t “emulate” films. It’s a computer program. It has no brain, no creativity. It can do nothing without the input of our past work. And then it can only spit out an amalgamation. It spits out nothing new. It has no creativity, no ideas, nothing new to say.
@MattBelloni
@JustineBateman
I’m not pro-AI, but what’s the difference, legally, between AI watching a bunch of films and emulating them, and human beings doing the same thing? George Lucas had Fox sue Universal over Battlestar Galactica and settled, but the knock offs kept coming.
A friend made a good point about the AMPTP’s desire to own background artists’ likeness w/
#AI
. What if they make it as an actor later? Then, as another says, “Whoops, we already own your rights. Congrats on making it, but we’re just gonna put you in a bunch of movies for free.”
Show them how it’s done.
They want to replace us w/
#AI
? Chop up our past scripts & bring out resulting patchwork films? Take actors’ likeness & use them however you want? Replace directors with software project managers,because you don’t need a “vision” or a point of view? 1/
