“Consequently, viewing all immigrants potentially subject to removal as criminals is, as a legal matter, plain wrong,” the judge wrote.

She also criticized the Trump admin's “repeated conjoined use” of words “criminal” and “alien” when remaining in the country unlawfully is generally a civil offense.

In her 88-page ruling, Judge Howell claimed DHS and high-ranking officials like Gregory Bovino made false claims about the standard needed to make warrantless arrests when they claimed they needed reasonable suspicion, not probable cause.

A federal judge has temporarily barred the Department of Homeland Security from conducting warrantless arrests in Washington, D.C. if they don’t have probable cause to believe that a person has violated immigration laws and is likely to flee before a warrant can be obtained.

“Moreover, since Defendant Bovino and his agents left the Northern District, Plaintiffs’ counsel has not received a single report of unconstitutional behavior that necessitated this case since November 8, 2025,” the plaintiffs wrote.

“We won our case the day they left town,” said attorney David Owens in a statement. “The people of Chicago stood up to the Trump administration’s bullying and intimidation, and showed them they were messing with the wrong city.”
