Thanks to TEL, the reviewers and colleagues who have contributed to the improvement of this publication.

We conducted a series of assessments aimed at translating ESL's theoretical agenda into practical recommendations for transformative changes to this international investment law instrument. The analysis engages both normative and analytical considerations.

By applying the ESL theoretical framework developed by Kotzé and Kim, we found that the ECT falls short in addressing contemporary socio-ecological challenges and navigating the complexities of the Anthropocene.

We have examined the ECT and its modernization through the lens of Earth System Law (ESL), a legal paradigm that fosters connectivity, facilitates the sustainable transformation of social processes, and evaluates the alignment of legal frameworks with the Earth system.

The article examined the legal framework resulting from the new EED and RED III. An overview of the relevant provisions in these legislative measures shows that many provisions increase the potential of Energy Communities as key players in the energy system.
