What “underrepresented” even means? I could be white and come from a broken home ,or have 2 severe ill parents. I would be more disatvantaged that any other color.

What if I am a white man who identifies as a black woman. Should they be forced to hire me? I know that sounds ridiculous but current events were ridiculous a few years ago. Where does it stop? Just make it merit based. It's fair for everyone.

How many categories are you going to use? Only race and sex (I can no longer use the word gender and be sure everyone knows what that is)? What about finances or family education history? What about orphan status? Can I find a protected status if I'm fat? Or unattractive?

“Manifest imbalance” is pejorative because it implies that a “balance” is somehow superior, fairer or more desirable. Those are not forgone conclusions.
