Looks like we're close to having high school #NIL permitted in West Virginia. The WV Secondary School Activities Commission's Board of Control unanimously approved (140-0) an amendment to its Handbook, which will now be presented to the State Board of Education for approval.

Trouble brewing in South Carolina regarding high school #NIL? The SC High School League recently altered its bylaws to still allow some form of NIL amid state legislators’ efforts to ban high school NIL via an addition to the upcoming state budget.

A bill has been introduced in Michigan that would bar schools from reporting #NIL contracts to the NCAA or Deloitte, prohibit schools from assisting any investigation, and ban athletic associations from penalizing athletes or schools for non-compliance.

A bill has been introduced in New Jersey that would exempt up to $100,000 of annual income earned by college athletes from the state's gross income tax, specifically for compensation related to their #NIL while attending a 4-year school within the state.

This New Jersey bill would also (1) allow schools to directly compensate athletes for their #NIL; (2) make NIL contracts exempt from public disclosure; and (3) prohibit the NCAA from penalizing schools due to a violation of their NIL rules.

A bill has been introduced to repeal the New Jersey Fair Play Act. Of importance, the bill would provide colleges legal remedies if they face penalties or threats from the NCAA for participating in #NIL activities that are permitted under the bill.

The Wyoming High School Activities Association recently approved its proposed #NIL policy in first reading. The second reading of the proposal will come at the WHSAA Board of Directors meeting in September.

There are only 3 days left in the legislative session, so Alabama lawmakers need to move fast if high school #NIL is going to become a reality in Alabama.
Alabama state Rep. Jeremy Gray has once again introduced a bill that would permit high school athletes in Alabama to capitalize on their #NIL. He introduced a similar bill last year that died in committee. Approximately 40 states permit NIL at the high school level.

Honestly, I'm a bit surprised a law of this type has been enacted. I believe this the first law of its kind to be signed during this cycle.
Louisiana joins AL, GA, & IL in proposing bills that would impact taxes on #NIL money. HB168 allows individual income tax deduction up to $12.5K earned by an athlete for using their NIL AND a corporation income tax deduction up to $12.5K per athlete for $ paid to an athlete.

The Arkansas bill creating an income tax exemption for income received by college athletes from their school as compensation for the use of their #NIL or as a percentage of school athletic revenue has been officially signed into law.
Another tax bill! An amendment to the Arkansas Student-Athlete Publicity Rights Act has been introduced that would, among other items, exempt income received by a college athlete from their school for use of their #NIL or as % of school athletic revenue from state income tax.
