i would say order of finish and purse payouts affected, but the same is true from positive drug testing and that can be appealed and purse funds held.
@DRFGrening
Don't know this, but think where we're heading is a federal court deciding whether the reg in KAR forbidding appeal of the DQ is unconstitutional. If the reg is declared unconstitutional, the door is opened for an appeal to progress.
@DRFGrening
when we walk through the gates the sign says " once your here its our rules" in the 80's when I heard jockeys appealing days or California tracks letting jocks ride stake races during suspensions that really seemed wrong.
@DRFGrening
Here it is. It isn’t valid but ... US Constitution prevents the taking of life,liberty or property by govt without due process. Earning a living is clearly covered so appeal allowed;KY has taken position a placing in a race is not property rights (wrong) so no right to appeal
@DRFGrening
I wouldn’t race at Churchill either, tho that’s because of CDI management, not the rules. As others have pointed out, non-appeal of DQs raises constitutional questons
