This is as good as it gets and there are more stars waiting in the wings, so I cannot fathom what anyone is waiting for. Especially because waiting runs the risk of a Democrat President filling seats with liberal activist lawyers who will not even pretend to follow the law. fin/.

We’ve covered Bove—but how about three more? Whitney Hermandorfer was one of the best litigators in the states, clerking for three Supreme Court justices. Jenn Mascott is a distinguished law professor with a long academic career and clerkships for two Supreme Court Justices. Eric.

Second, what about other judges retiring? I have no insight into the thoughts of any judge, but have great trouble seeing any originalist, textualist judge declining to retire in the face of @realdonaldtrump’s nominees. The current crop of nominees is excellent, top to bottom. 9/.

@WSJopinion faults Bove for linking the dismissal to immigration enforcement, but I'm not sure why that matters. The upshot of continuing the case is seeking to imprison Adams based on a flimsy indictment. That is bad by any measure and Bove deserves credit for stopping it. 8/.

The second objection concerns Bove’s role in dismissing the Eric Adams case. As I wrote post-indictment in @WSJopinion, that weak case should never have been brought. Bove explained as much in accepting the Acting U.S. Attorney’s resignation. 7/.

As for the profanity, give me a f*cking break. I've had many heated meetings in government on important topics under immense pressure following little sleep. Yes: Such meetings sometimes feature more F Bombs than Joe Pesci after six martinis. This is politics, not the papacy. 6/.

Considering potential courses of action is what lawyers do; they have an ethical obligation to analyze all aspects of every case. That includes separation of powers questions potentially implicated by district court orders purporting to command the President. 5/.

I will assume for present purposes the “worst” version of the alleged facts. That is, I will assume Bove used profane language to suggest that the Executive Branch consider ignoring a future, then-hypothetical court order. I think it ultimately doesn’t matter. 4/.

What about @WSJopinion's objections? The main objection concerns a meeting in which Bove allegedly asked colleagues about defying a potential court order and did so using profane language. Lets unpack both claims. 3/.

First, as I have written elsewhere, Emil Bove is a strong nominee right down the fairway of @realdonaldtrump’s long track record of excellent appointments. He has strong credentials and is a senior official @TheJusticeDept in the Administration. Straightforward pick. 2/

The @WSJopinion has an editorial today arguing three basic things: (1) Emil Bove is a poor judicial nominee, (2) his nomination will stop other judges from retiring, (3) other Trump nominees are better and will induce more retirements. I broadly disagree. 1/
